INTRODUCTION

 

Please take the time to read our terms and conditions, payment of your booking fee and receiving your booking summary assumes that you have read and agree to all the terms and conditions listed below.

 

 All BRIDES (Client) are advised to take out wedding insurance.

 

Terms and Conditions when booking Sarah Sharpe MUA – ARTIST.

 

These are the only terms and conditions on which the ARTIST will supply the Wedding Trial Services and the Wedding Day Services (and/or any other professional services) to the BRIDE.

 

ENQUIRIES:

 

  1. Booking enquiries can be made via enquiry form, telephone or email.
  2. The Artist will supply you with a personalised quote and confirm availability – No dates can be held or reserved provisionally at this stage.

 

  1. If you would like to Book, please confirm this in writing at your earliest convenience, following this, your Booking Summary will be sent out to you and your Wedding Date held for 5 days.

 

  1. Your booking is not secure until your booking fee has been received in full and the Artist has confirmed receipt in writing. We reserve the right to rebook or cancel your date if fees are not paid on time.

 

 

SECURE YOUR BOOKING:

 

  1. Clients are required to pay a NON-REFUNDABLE 50% Wedding Day balance booking fee which will be deducted from the final wedding day balance. This holds your trial and wedding date in the diary until 3 days after your trial takes places.

 

  1. These Terms and Conditions will become binding when the BRIDE receives the booking summary and decides to transfer the booking fee to the ARTIST, the BRIDE has 5 days to pay the non-refundable booking fee from the day the BRIDE receives the booking summary email from the ARTIST. The BRIDE will be advised that this has been sent, after these 5 days if the booking fee has not been paid, the date will not continue to be held.

 

  1. The ARTIST will provide a booking summary and confirm receipt of the booking fee. It is the client's responsibility to check the booking summary and ensure that the ARTIST is notified of any errors within 5 days of receipt. If the client notifies the ARTIST of an error after this period, and the ARTIST is unable to fulfil the booking, cancellation fees may apply.

 

  1. Dates cannot be confirmed until booking fee is received and the booking summary is correct. If the wedding day is within 12 weeks of booking, the full amount will be required to secure the date.

 

  1. If any of these Terms and Conditions conflict with any term of the Booking Summary, the Booking Summary will take priority.

 

 THE SERVICES:

  1. The ARTIST will supply the Wedding Trial Services and the Wedding Day Services (and/or any other agreed professional services) to the BRIDE at the time and on the date confirmed in the Booking Summary for the agreed price and at the location identified therein.

 

  1. For the avoidance of doubt, the professional services to be provided by the ARTIST will be confined only to those agreed in advance and specified in the Booking Summary.

 

  1. The provision by the ARTIST of any additional services on the wedding day itself (to include the provision of services to any additional third parties) will be entirely at the discretion of the ARTIST. The BRIDE accepts that the ARTIST shall be under no obligation whatsoever to provide any such additional services beyond those identified in the Booking Summary. The BRIDE understands that there may not be sufficient time or product available to the ARTIST to provide any additional services.

 

However, if the ARTIST does agree (at her discretion) to provide any additional services other than those identified in the Booking Form, this will be at a price to be agreed on the day which will be due and payable immediately.

 

WEDDING MAKEUP TRIAL:

  1. Trial Session – required at least 3 months before the BRIDE'S wedding date. Trial sessions are available for Bride and your Bridal Party members. All Brides must have a trial session.

 

  1. Trial Payment -Trial sessions are to be paid 7 days in advance of your trial date and must clear before your Trial. Trials are paid separately to your Wedding booking.

 

  1. Trial Location – Your trial session will take place at my home studio in Helsby, Cheshire in the majority of instances. (A mobile service is available if necessary – Mileage will apply)

 

​16. Trial Cancellations/Changes - In the event that a BRIDE does not pay for a trial session 7 days in advance and subsequently cancels any trials booked (Bride or bridal party) a payment of 50% of the trial is required. 50% payment of the trials cancelled would be due to be paid by bank transfer on the date of the arranged trial session. ​The BRIDE agrees, accepts and understands that the cost of the Wedding Trial Services remains payable in this instance.

 

  1. It is up to the ARTIST'S discretion in very unusual circumstances to re-arrange a trial with a discount (i.e the remaining 50%). It is expected that the new trial date will be paid for in full.

 

  1. If you require a second trial you will need to pay the full trial amount again. 

 

  1. The trial and travel costs are completely non-refundable.

 

  1. Change of Trial Date - Any changes made by the bride to a trial must be made in writing at least 7 days before the date of the trial and an alternative date will be found. 

 

  1. Change to Trial Numbers - If changes result in the number attending being reduced, we have the right to change the time or date of the trial.

 

​22. If the trial session booked needs to be regrettably changed by the ARTIST, the ARTIST will give 2 weeks’ notice where possible, if the BRIDE has already paid for trials booked monies will be either refunded or carried over to the next trial date.

  ​

  1. Brides must make the ARTIST aware of any allergies to skincare, makeup or hair care so that the correct products are used. Brides must complete the consultation form to inform the Artist of any contraindications.

  1. In booking the Wedding Day Services, the BRIDE acknowledges, agrees and accepts that she is not to leave her trial session until she is happy with the results of the Wedding Trial and wishes for the ARTIST to replicate that look (as close as is reasonably possible and practical). Please be realistic with what can be achieved, trial sessions require a lot of imagination as BRIDES will not be wearing their wedding dress, have flowers or be in a beautiful wedding venue. Sometimes some BRIDES find that their trial can be more of a discovery of what they don’t want and can sometimes need a second trial. Sometimes BRIDES choose a look and change their mind, this is one of the reasons the ARTIST asks a BRIDE to firstly book in for a trial at least 3 months before their wedding day, the ARTISTS' main aim is to make BRIDES feel comfortable and feel happy with their final look.

 

  1. Contraindications that PREVENT a Facial Treatment:

Bacterial infections such as impetigo, boils, conjunctivitis, styes, Fungal infections such as ringworm, blepharitis, known sensitivity or allergy to products. Eczema, psoriasis, cold sores, fresh bruising, open sores/abscess, head lice, unstable blood pressure, recent head injury, recent neck injury, fever, contagious disease, recent scarring, severe acne.

 

26. Contraindications that could RESTRICT a facial treatment:

The following conditions are contraindications that will not necessarily stop the treatment from taking place but they may mean that the treatment is restricted or may have to be adapted: Cuts/abrasions/broken skin, Bruises or swelling, Recent scar tissue (less than six months old), Eczema, Dermatitis, Psoriasis, Acne vulgaris, Acne rosacea, Skin tags, Milia, Recent sunburn.

Current medication that may affect treatment needs to be disclosed.

 

ALLERGIES:

 

  1. The client must inform The Artist of any allergies or product sensitivities they may have before the trial takes place. This also includes but is not limited to, medical conditions or any issues that may affect the use of equipment’s and products. 

 

CHANGES:


  1. Notification should be given of any changes to the booking and trial as soon as possible. This includes changes to the number of clients, location, dates and times. It is the client’s responsibility to do this as we cannot guarantee availability all day.

 

  1. Changes must be confirmed in writing via email and are not accepted as written notice until you have received a reply from The Artist. Please do not rely on texts as we do not always receive them. 

  1. Change of Wedding Date - We will do our best to book the new date or supply another available artist. If this is not possible then the usual cancellation fees apply.

 

  1. Change to Wedding Day numbers - A new price will be calculated based on our current price list to reflect any changes in the bridal party.

 

  1. Change of Location - We may need to add a travel charge if the location changes. If the location changes dramatically we reserve the right to cancel the booking.

  1. If the booking is directly affected by circumstances beyond the control of the artist, every possible endeavour to rectify such situations will be made, however no compensation will be offered on the artist’s part. The client is strongly advised to take out wedding insurance to cover against such situations.

ADDITIONAL CHARGES:

 

  1. If preparation is split between 2 locations, a pack down/re-set up fee of £35 will be charged. 

  1. If any booking is an early start of before 6am for the ARTIST, there may be a surcharge or overnight accommodation costs

  1. The client will cover all necessary travel expenses, including, but not limited to, all public transport costs, any congestion charges and parking charges that are applicable; these will be added to the final invoice.

ASSISTANTS:

 

  1. If your booking requires the help of an extra assistant there will be a £200 charge per each assistant.

PAYMENT TERMS:

​38. Paying your Balance - Three months before the wedding date the cost of all agreed Services - including the Wedding Trial Services and the Wedding Day Services (and/or any other professional services) - becomes immediately due and payable in full without deduction, even if, unfortunately cancelled subsequently by the BRIDE.

 

  1. For the avoidance of doubt, the BRIDE agrees, accepts and understands that the ARTIST is under no obligation nor can she be required to provide a refund, whether in part or in full, if the Wedding Day Services are cancelled at any time prior to the date of the wedding (other than if cancelled by the ARTIST herself).

 

  1. The price of the Wedding Trial Services, the Wedding Day Services and/or any other professional services to be provided by the ARTIST are set out in the price list in force at the time. Prices may change at any time, but subsequent price changes will not retrospectively affect the cost of the Wedding Trial Services and the Wedding Day Services confirmed on the Booking Summary.

 

  1. Prices are not subject to VAT.

 

  1. If any payment due to the ARTIST is not made by the due date for payment, the ARTIST may charge interest on the overdue amount at the rate of 10% a year above the base lending rate of the Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount.

CANCELLATION & FEES:

  1. Please note that all changes or cancellations MUST be stated in writing. If for any reason you must cancel your booking, you need do this in writing 12 weeks before your wedding date. If notice is given after this, the full outstanding amount is due.

 

  1. Cancellations for services booked where travel and/or accommodation expenses have been paid for by the ARTIST and are non-refundable by the provider will need full payment by the client.

CANCELLATIONS made by The Artist: 

 

​47. In exceptional circumstances, such as a hospital stay, The Artist may need to cancel a booking. This has never happened before but, if it does all attempts will be made to find an alternative artist. If this is not possible or is unacceptable to the client, The Artist will refund 100% of the deposit/payment.

  1. We reserve the right to cancel any booking that has been made under false pretences without liability and retain all payments made by you. 

 

LIMITATION OF LIABILITY:

 

  1. The BRIDE acknowledges that the ARTIST has given no warranty, condition or undertaking, whether express or implied by statute or common law, as to the provision of the Wedding Trial Services, the Wedding Day Services and/or any other professional services to be provided by the ARTIST.

 

  1. All implied terms, terms, conditions and warranties are expressly excluded to the extent permissible by law. 

 

  1. The ARTIST is not responsible for any loss or damage incurred by the BRIDE or by any other person howsoever arising at the trial session or wedding day to any person, property or vehicle.

 

  1. The ARTIST does not exclude or limit in any way her liability for losses arising as a result of death or personal injury caused by her negligence; or fraud; or fraudulent misrepresentation.

 

  1. The ARTIST shall not be liable to the BRIDE for any loss of profits, revenue, contracts, anticipated savings, loss of enjoyment, loss of expectation or any other indirect or consequential loss, howsoever arising.

 

  1. In any event, the ARTIST shall not be liable to the BRIDE for more than the price of the Wedding Trial Services, the Wedding Day Services and/or any other professional services actually delivered by the ARTIST. The BRIDE agrees and accepts that this is entirely reasonable in the circumstances.

 

  1. The ARTIST shall not be liable or responsible for any failure to perform, or delay in performance of, any of her obligations hereunder that is caused by an event outside her control including, without limitation, robbery of kit needed to carry out her work, road traffic accident, delayed/held in traffic, fire, flood, epidemic or any other natural disaster, or failure of public or private telecommunications or transportation networks or damage to or failure of any mode of transportation used by the ARTIST. 

 

  1. The BRIDE accepts and understands that the ARTIST takes no responsibility whatsoever for any reactions to any products used, allergic or otherwise. 

 

  1. The BRIDE accepts that it is her responsibility to make sure any clothing and accessories needed for the wedding day is kept out of the way of the Artists hair and makeup working area, if anyone in the bridal party gets products of any kind on clothing or accessories the ARTIST cannot be held liable.

 

  1. The BRIDE agrees that if for any reason the ARTIST cannot attend on the day of the wedding, then the ARTIST will use her reasonable endeavours to ensure that the relevant professional services are provided by another suitable makeup ARTIST/hair stylist. If for any unforeseen circumstances, it is not possible to replace her, the ARTIST will endeavour to inform the BRIDE at the earliest opportunity.

 

INTELLECTUAL PROPERTY:

 

  1. At the time of the Wedding Trial, photos and notes may be taken by the ARTIST to ensure that the look is capable of being recreated on the wedding day. These notes and photos can also be used if a replacement ARTIST is appointed. 

 

  1. These notes and photos (and/or any taken at the wedding) remain the property of the ARTIST and the BRIDE agrees that all images of her, her Wedding trial and of her wedding itself can be used for all promotional, advertising and professional purposes of the ARTIST without charge or payment.

  2. The client agrees that the artist may use any photography for publicity purposes which include but are not limited to the ARTIST’S website and social media pages.

 

THIRD PARTY RIGHTS:

 

  1. This contract is between the ARTIST and the BRIDE. No other person shall have any rights to enforce any of its terms.

 

SEVERABILITY:

 

  1. Each of the clauses of these Terms and Conditions operates separately. If any court or relevant authority determines that any of them are unlawful, the remaining clauses will remain in full force and effect.

 

WAIVER:

 

  1. If the ARTIST fails to insist that the BRIDE performs any of her obligations under these Terms and Conditions, or if the ARTIST does not enforce her rights against the BRIDE, or if the ARTIST delays in doing so, that will not mean that the ARTIST has waived her rights against the BRIDE and will not mean that the BRIDE does not have to comply with those obligations.

 

  1. If the ARTIST does waive a default by the BRIDE, she will only do so in writing, and that will not mean that the ARTIST will automatically waive any subsequent default by the BRIDE.

  

GOVERNING LAW AND JURISDICTION:

 

  1. These Terms and Conditions are governed by English law.

 

  1. The Parties agree to submit to the exclusive jurisdiction of the English courts.

 

ENTIRE AGREEMENT:

 

  1. The Booking Summary, Confirmation Of Booking and the Terms and Conditions constitutes the entire agreement between the Parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

 

  1. For the avoidance of doubt, any agreed amendment to the Terms and Conditions will only be valid to the extent that it is agreed in writing as between the Parties.

 

OTHER:

  1. Following the new smoking regulations - smoking whilst an artist is working is not permitted.

 

  1. Artists reserve the right to refuse to work if a client is rude, aggressive, upsetting or abusive in any way. In this situation the booking will be cancelled, and the trial fee will be retained.
